Terms of Service
Welcome to Daniel Amezcua Photography. By accessing and using our website or booking our services, you agree to comply with the following terms and conditions. Please review them carefully before making any purchases or bookings.
1. General Terms
By booking a session or purchasing digital images through Daniel Amezcua Photography, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.
We reserve the right to modify these Terms of Service at any time without prior notice. The latest version will always be available on our website, and it is your responsibility to review these terms periodically.
2. Booking and Payment
A 50% non-refundable deposit is required to secure your session booking. The remaining balance must be paid in full on or before the day of your session.
All session bookings are confirmed only upon receipt of the deposit. If payment is not made within the stipulated time, we reserve the right to cancel your session.
3. Rescheduling and Cancellation
If you need to reschedule your session, you must notify us at least 72 hours before your session date. In this case, your deposit will be transferred to the new date, subject to availability.
Cancellations made with less than 24 hour notice or failure to show up for your session will result in forfeiture of the deposit. No refunds will be issued for cancellations unless due to an emergency on our end.
4. Digital Images and Delivery
All digital images included in your package will be delivered within 2-3 weeks after the session.
Digital downloads are final and non-refundable. Once delivered, clients are responsible for backing up and securely storing their files.
5. Image Usage and Copyright
All images taken by Daniel Amezcua Photography remain the exclusive property of Daniel Amezcua Photography. By booking a session, you purchase a license for personal use only. This includes printing for personal enjoyment, sharing on personal social media, and private portfolios.
You may not use images for commercial purposes, resale, or any other unauthorized use without prior written consent from Daniel Amezcua Photography.
We reserve the right to use your images for promotional purposes (including social media, website, and marketing materials). If you prefer that your images not be used for these purposes, please inform us in writing prior to your session.
6. Print and Product Orders
All print and product orders are custom-made and non-refundable once the order has been placed. If there is any damage to the products upon delivery, please contact us within 7 days of receiving the item for a replacement.
7. Limitation of Liability
Daniel Amezcua Photography is not responsible for any personal injury, damage, or loss that may occur during a session or as a result of using our services.
In the event of unforeseen circumstances, such as equipment failure, illness, or emergencies, we reserve the right to reschedule your session or refund your deposit.
8. Client Conduct
We strive to create a comfortable, professional environment for all clients. We reserve the right to terminate any session, without refund, if a client’s behavior is deemed inappropriate or disrespectful.
9. Privacy Policy
Your privacy is important to us. Any personal information collected during the booking process will be used solely for the purpose of providing our services and will not be shared with third parties without your consent.
